The legal battle with former employer Activision is beginning to take a toll on ousted Infinity Ward heads Jason West and Vince Zampella, as the duo claim in new court documents that Activision is deliberately trying to delay the case from going to trial, and the mounting legal fees and time spent dealing with the lawsuit are draining their personal funds and delaying them from getting their new studio up and running.
In December, Activision
amended their complaint to include Electronic Arts, which West and Zampella entered into a publishing deal with when forming their new company, Respawn Entertainment. Activision claimed that EA "conspired" to draw West and Zampella into a new independent company while they were still Activision employees, but in the new court documents released today (via
Kotaku), the duo claim that Activision knew of any alleged "conspiracy" regarding EA six months before they added the publisher to the complaint, and waited to do so only in a deliberate attempt to delay the lawsuit past the original start date in May.
In the documents, West and Zampella say they are "paying for this litigation from our own funds," and that to date the total legal fees have "[exceeded] our combined annual salaries." Furthermore, they also say the time they've had to devote to fighting the case have delayed them from getting Respawn operating at full steam, which already employs "dozens of employees."
