They do, but they're being sued by Respawn Entertainment for the rights to the franchise.

Their being sued for the rights to the Modern Warfare franchise. Activision will still own the COD name even if Respawn wins their case and Modern Warfare would cease to bare the COD brand. Which wouldn't be a bad thing. IW wanted to drop the COD name from MW2 to let it stand on it's own legs but Activision didn't think it would be wise. That's why the collector's editions just say "Modern Warfare 2" and the regular copy has the COD moniker on it.

I agree that it wouldn't be wise, in US, they call call of duty: modern warfare 2 by "modern warfare 2", but in asia, they called it "Call of duty 6". Most population resides in Asia, and if you don't have the "Call of Duty" tag, i don't think alot of people will recognize Modern warfare 3.

I could of guessed it was you, just from the thread title.

And Activision don't "make" games as such, they are primarily a "publisher" similar to EA, Ubisoft or Bethesda (which obviously do make games internally), as opposed to a developer, like IW, Treyarch, Valve etc.

Respawn themselves will decide (may already have) where MW3 will go.

Activision have the rights to PUBLISH the games, i.e. put their name on the box, and make some money. Everything else, i.e. the story, graphics, testing, coding, ANYTHING TO DO WITH MAKING THE GAME all final decisions will be solely in the hands of the DEVELOPER, Respawn.

Is this lawsuit still going on? I can't find details on it, only the missing royalties one.

If it is still going on, if Activision win they'll have a lot of control over it because they get to decide who the developer is, etc. If Respawn win, EA will publish it.
